North American food policies may pivot in 2025

Food business operators with a presence in North America need to pay close attention to policy signals from the Trump administration. The coming year could bring a significant shift in regulatory direction and prioritisation in the US. Any changes to US food and beverage regulations may also have implications for Canada.

Canada’s regulatory scene was quiet last year following the implementation of several major regulations in 2023. In the US, various Food and Drug Administration (FDA) guidance documents or draft guidance documents related to the food and beverage industry were tabled for 2024, with a number published in the final weeks of the Biden-Harris Administration:

  • Questions and Answers regarding food allergen labelling requirements guidance – The FDA finalised its allergen guidance on 6 January 2025. This includes an update on its definitions of milk, eggs, and tree nuts
  • Plant-based labelling guidance – Draft guidance on the labelling of plant-based alternatives to animal-derived foods was published on 7 January 2025. It outlines recommended best practices for the naming and labelling of these products
  • Front of package nutrition labelling (FoPNL) – On 16 January 2025, the FDA published its proposed rule on front of pack labelling that, if finalized, will require a “Nutrition Info” box on most foods, declaring saturated fat, sodium and added sugar content as a daily value with a qualification of “high”, “med”, or “low”
